LOS ANGELES PERSONAL INJURY: SETTLE OR TRIAL?

Posted by Robert Walch | 13 February 2018 | 0 Comments

To settle or not to settle…that is the question. Well, it’s actually significantly more complicated than that but you get the point. When you are dealing with a Los Angeles personal injury of any type (wrongful death, slip and fall, serious car accident, etc) it can be confusing to decide whether you should take the settlement offer or go to trial. The attorneys at Walch Law are here to help with that decision and every other one along to the way to ensure that your financial recovery is maximized.

Here’s the top questions around this very important and very common topic:

  • Is one better than the other? Not necessarily. There is no hard and fast rule that settling is always going to end in more money than going to trial or vice versa. It all depends on the specifics of your case. While there is predictability is a settlement because you sign the agreement knowing exactly what you are going to get, trials can exceed or be lower than what you would get settling. It all just depends and you can feel confident with us as your attorneys that we will give you the appropriate direction.
  • Do I have a choice between settling or going to trial for my Los Angeles personal injury case? Sometimes you do have a choice and sometimes you don’t. When you have a choice that usually means that you don’t like what seems to be the highest settlement offer from the other side’s insurance company (or other defendant) and you think you can get more at trial. When you don’t really have a choice it means that you have previously signed an agreement to arbitrate or the other side is not even offering a settlement then your option is very clear.
  • Insurance has quickly offered a settlement, should I take it? NO! Unlike other things in life, the first offer is rarely the best. What is happening in the quick settlement offer cases is that the insurance company is trying to very quickly get rid of you by throwing some money at your case before you have time to get an attorney and get advised on all your options and before you might know the extent of your injuries and true financial needs. Don’t take the offer before getting in touch with us for a free review.
  • What are the pros and cons of each option? We will go over this with you more during your initial free consultation with us but here’s a quick break down of why you might prefer one over another. A settlement is generally much quicker than a trial and many clients know exactly what they are going to end up with. A trial, while longer than a settlement can end up with more money and might be a good option when you have an injury or death where the defendants actions are particularly bad. For instance, check out the recent Xarelto verdict ($28 Million) against Johnson and Johnson.
