LOS ANGELES TO PAY $6.5 MILLION TO BICYCLIST INJURED BY POTHOLE

Riding you bike in LA can be a wonderful exercise in the nearly perfect year round weather. Until it isn’t. We recently blogged about the terrible state of Los Angeles sidewalks. So terrible that the city has agreed to pay $1.3 Billion to fix them. Now you can add $6.5 Million to the tab.

UPI.com reports on the large settlement recently approved by LA City Council, “In 2015 Peter Godefroy lost control of his bike after he hit the pothole and allegedly suffered severe traumatic brain injury and numerous broken or fractured bones throughout his body.”

In his suit against the city, Godefroy alleged that the city knew of the heavy bike traffic on the road he was injured on in Sherman Oaks and did nothing to make the conditions safer. He attributed poor street lighting and terrible road conditions to his fall. In addition to this multi-million dollar settlement, the city also paid $4.5 Million to the family of a man that died after being thrown off his bike when he hit uneven pavement.

On the busy roads of California, bicyclist are always on the lookout for distracted drivers and dangerous roadways. And while a helmets can save lives, the trauma that a high speed fall or collision can cause a rider is tremendous, if not deadly. Whether you are injured by another driver or a dangerous roadway, this is not a financial burden you should have to handle on your own. In the case of those injured by dangerous roads and other city street conditions, you have the ability to sue the city. If you have been injured by a car or motorcycle, you can file suit against car insurance companies, including your own in those scenarios where there is no or not enough insurance carried by the other party. Bottom line: there is money but you cannot delay in seeking compensation. This is true even if a biker was partially responsible for their own injuries or death– an important caveat that many of our clients do not realize until they speak with us.
