FDA Black Box Warnings

The Food and Drug Administration not only approve the drugs that hit the U.S. Market but supervise them along the way and warn doctors and patients about any issues a given drug may cause. When a new drug is approved for marketing, the FDA has made a determination that their benefits outweigh the potential risks to patients. That being said, the FDA will often issue warnings and other communications around a drug when more clinical or other data is collected indicating potential risks. The most serious warning issued by the FDA is known as a black box warning.

What is a black box warning? As the name indicates, it is a warning in a black box placed around it to warn doctors and pharmacists of the serious risks associated with taking a certain drug. This type of warning can be placed on a drug when it is first approved but is more commonly inserted after approval when more data is available about a given side effect. Diabetes drugs Actos and Invokana are just two examples of drugs that received black box warnings after being on the market for some time.

While drugs can heal and relieve, they can also be very dangerous to patients. The existence of a black box warning or a drug recall does not preclude you from filing a personal injury or wrongful death lawsuit for your injuries or loss. In many instances, the pharmaceutical company is responsible for failing to warn patients about the potentially deadly side effects a drug might have. Too often these companies are motivated by money over safety and that simply is not right. If you have been injured by a drug or lost a loved one, there are very strict deadlines before you lose your chance to file suit. The compensation for your injuries or loss can be substantial-- give us a call today to learn more.
